- It is not clear to me why this would be in the public domain. File:University of California Seal.svg appears to be neither {{PD-USGov}} nor {{PD-CAGov}}, so it would seem that if it is a creation by the university, it would not be subject to government copyright exemptions. - =2? We cannot prove 100% any user owns any website. It wouldn't be the first time that a user creates a username as a "fan" of a website. We have to be 100% confident that no person's copyright has been violated, WP:AGF cannot apply in such cases. In this case the image definitely appeared on a web site with no license prior to the wikipedia upload, therefore we have to assume a copyright violation, unless the web site owner can prove he is the same as the user, either by adding a license to the web site, or by OTRS ticket. - This reasoning is so ridiculous I'm not even sure how to argue against it. If I had put it up here first it would be fine, but since it was up first on a site with my name and personal information the same as in my user profile, linked to in my user profile, it's assumed to be a violation despite no actual evidence? It's already tagged with "I created this," but you flagged it as "blatant copyright violation". If you don't accept that, then if I put a license on the site, how is it any less likely that I didn't put it up there after copying it from somewhere else? 100% confidence is impossible, especially if you imagine how much can be concocted. - It says that this is a derivative work of File:Blue Puzzle Marble in stand.png. That file was removed a few weeks after uploading this file because it was a "copyright infringement subsequently detected by the creator". It is thus likely that this also is a copyright infringement. I also think that XCF might not be the most appropriate file format for storing files on Wikipedia. - Not free. The full sentence from the terms is "the downloading, copying and use of the Content will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secret rights, of any third party" (emphasis added). This means that uploaders of content agree that their content does not infringe on someone else's copyright.
