This looks like a good indication that all of the uploader's files were under CC-BY in the past. Would a court complain due to the fact that this exact image isn't on that archive.org page? A CC-BY licence can't be repealed, but if there is no way to prove that the image once was licensed under CC-BY, a court might not trust you, de facto meaning that the licence has been repealed.

One could argue that you have several "witnesses" on dewiki. Do you think that the witnesses checked the licence on Flickr, or did they just modify the file information page? --Stefan2 (talk) 12:50, 20 August 2014 (UTC)[reply]

flickr has always been a problem (allowing to change licences without a change history). The commons community solved this by trusting certain people to review the image and decide upon their status (see commons:Template:Flickrreview). At de.wp at two user flagged ("sichten") the image, which should mean that is was not a copyvio at that time. However, this is en and different projects have different standards. Yes, c:Template:Flickr-change-of-license is a problem as you are out of luck if you can't prove that the Flickr user has changed the licence to a more restrictive one. I guess c:Template:Flickrreview makes the reviewer a "witness" who might be asked for information if there is a legal dispute about the licensing status of an image.

I'm not necessarily checking Flickr licences when editing a page unless I'm specifically making a licence review and adding relevant templates. If I understand things correctly, the German "sighting" thing mainly seems to be a statement that a certain edit isn't vandalism. One editor "sighted" the addition of a category, and another editor "sighted" an edit about Belgium not having any FOP, but those "sightings" weren't really about the CC-BY licence claim. On the other hand, the file has been around for a very long time, and it was shown that lots of other pictures by the Flickr editor had a {{flickr-change-of-license}}, so it is unlikely that the Flickr user didn't license this picture too. It is also likely that the user who copied the image to English Wikipedia from German Wikipedia checked the licence when copying it here. I would therefore assume that it is safe to keep the image. On the other hand, if we simply choose a different photo of the Atomium (which should be readily available), we will avoid this whole problem. --Stefan2 (talk) 23:14, 21 August 2014 (UTC)[reply]
