La fotografía fue tomada el 31/05/2009 en una exposición temporal dedicada al escultor en la Capilla del Oidor (Alcalá de Henares) durante la que el busto fue retirado de su localización habitual, en un pequeño jardín de la calle del Empecinado de dicha ciudad. El 22 de mayo 1813, Juan Martín Díez "El Empecinado" ayudó en la defensa de la ciudad de Alcalá de Henares (Madrid), y en el puente de Zulema, sobre el río Henares, venció a un grupo de franceses que le doblaban en número.
