The result of the discussion was: Keep, general consensus is that this is probably in the public domain, and it appears that further attempts are being made to verify this situation. - Tbsdy (formerly Ta bu shi da yu) talk 10:58, 31 January 2010 (UTC)[reply]

- An image of a high ranking US federal employee, it is inconceivable that a single image of this employee was not made by their employerFasach Nua (talk) 23:16, 16 January 2010 (UTC)[reply]
- I have no idea whether US appeal court judges are usually photographed officially. Official photographs of Combs as governor of Kentucky would not normally be in the public domain as they would not usually be words of the federal government. The Sixth Circuit page on Combs uses a modern portrait of him. But the image nominated here could, as it says on the image page, be in the public domain: "Anything published before March 1, 1989 with no copyright notice ("©", "Copyright" or "Copr.") plus the year of publication (may be omitted in some cases) plus the copyright owner (or pseudonym) is in the public domain." So, too, may be the Sixth Circuit's portrait which was presented (and evidently "published") on 8 February, 1989. Clearly this would need checking, but I think there is a good chance that one or both would be covered by {{PD-art}}. Angus McLellan (Talk) 21:23, 17 January 2010 (UTC)[reply]
I have made several good-faith efforts to locate a PD image of Combs, as evidenced at Wikipedia:Featured article candidates/Bert T. Combs/archive1. Continuing to argue that there must be a PD image of him out there because it is "inconceivable" that there isn't strikes me as begging the question. Asking me to prove a negative (i.e. to prove that there isn't a PD image of Combs somewhere) is unfair; I've already indicated my willingness to use any PD image that may show up in the future, but until such time as such an image shows up (or even evidence of such an image shows up), I think the present image should be allowed to remain on fair use grounds. BTW, User:FloNight has agreed to check in The Bert T. Combs Collection at the University of Kentucky at her next opportunity, whenever that is. She's much closer to that institution than I am. If she finds a PD image in that collection, I'll be the first to support deletion of the fair use image in favor of the PD one. Acdixon (talk • contribs • count) 14:44, 19 January 2010 (UTC)[reply]
- Keep Possibly public domain. If non-free, still acceptable as a free equivalent clearly cannot be found or created at this time. A Stop at Willoughby (talk) 04:14, 22 January 2010 (UTC)[reply]
- "possibly free" is not a consideration for an image used under a fair use rationale, we do not have degrees of non-free. WP:NFCC makes no provision for editor to add non-free content because they are unwilling to fully research the subject, and I have little doubt that free images of this high ranking federal employee are available, even if they are not accessible by the trivial an act as typing the the name into google. Fasach Nua (talk) 12:07, 24 January 2010 (UTC)[reply]
- I have done more than typing the name into Google. In fact, I have pursued every avenue you have suggested for finding such an image, and still have turned up nothing (excepting searching the collection at the University of Kentucky, which physical geography prevents me from doing. I've got someone committed to searching there when their schedule allows.) Just because you have "little doubt" that a PD image is available doesn't make it so. What if one doesn't turn up in the UK collection? Will you still maintain that one must exist because you think it must? It's impossible to prove that one doesn't exist, but until you prove that one does, I think the good faith efforts that have been made to locate one should be considered reason enough to keep the present image on a fair use basis. - Keep The free image mentioned does not really replace this one; I disagree that this fails WP:NFCC#1. As for WP:NFCC#8, I submit that describing a political party's logo with prose is not as effective at enhancing the reader's understanding as an actual image of the logo. - File:USA Network 1st logo.gif (delete | talk | history | logs) - uploaded by Danang S. ( | contribs).
- Invalid use of a historical logo. At time of nomination, is orphaned, but uploader continues removing orphan tag and readding it to the USA Network as part of a non-free "historical logo" gallery, with out the required critical commentary and sourced content to show why this logo is historically significant. Further, the logo is not significantly different from the current logo, File:PerfectUSA.svg, as both are purely stylized text of the station name. While technically these can be considered "public domain", it is also still trademark and I see no valid reason to keep multiple copies of a similar trademark around when only one is needed. -- Collectonian (talk · contribs) 07:24, 16 January 2010 (UTC)[reply]
