Licensing
It is asserted that the use of this image in articles pertaining to or in reference to KSDK and its associated properties qualifies as fair use for the following reasons:
- It is a low-resolution copy of the logo;
- It does not affect the market for the original work — this is a logo created to promote a television station, not a commercial work sold to the public for profit;
- By the nature of the image, no free alternative is possible;
- The logo is widely identified with KSDK via posters, on air id, advertisements etc. and so the inclusion of the logo adds significantly to the articles in which it is used
